Azam & Rai partner, R.M.S. Azam, at the invitation of the Labour & Human Resource Department, Government of the Punjab, participated in the Stakeholders' Consultation Session held at the Pearl Continental Hotel, Lahore on 24 March 2014.
At the Session, Mr. Azam represented the Center for Law and Policy, Lahore, which is undertaking the project for consolidation, simplification and rationalization of the labour and employment laws of the Punjab Province and their harmonization with ILO Conventions ratified by Pakistan as part of the Pakistan-EU Trade Project to bring Pakistan's labour laws in conformity with international conventions to enable Pakistan to take advantage of the Generalized System of Preferences (GSP) Plus status, which was accorded to Pakistan for three years by the EU in December 2013. The GSP Plus status will allow almost 20% of Pakistani exports to enter the EU market at zero tariff and 70% at preferential rates, thereby increasing Pakistan's annual exports by around USD $2 billion.
The Stakeholders' Consultation Session was convened as a prelude to the ministerial-level South Asian Labour Conference to be held in Lahore from 24-26 April 2014 under the auspices of the Labour & Human Resource Department, Government of the Punjab, and supported by the Government of Pakistan, the South Asian Association for Regional Cooperation (SAARC), the International Labour Organization (ILO) and the European Union (EU).
During the Session, Mr. Azam chaired the tripartite Working Group on the "Harmonization of Labour Laws and Policies in line with International Labour Standards" in which representatives from the government, industrial employers and labour trade union representatives gave their recommendations.

Lahore High Court suspends PTA's Enforcement Order in Appeal filed by LDI Licensee through Azam & Rai

In a First Appeal against Order (FAO) filed by Azam & Rai in the Lahore High Court, Lahore on behalf of a Long-Distance International (LDI) Licensee against the Pakistan Telecommunication Authority (PTA), the Lahore High Court has suspended PTA's Enforcement Order against the LDI Licensee.
The Appeal is in relation to a dispute arising from a Complaint filed with the PTA by a Local Loop (LL) Licensee against the LDI Licensee. On the basis of the Complaint, the PTA, through its Enforcement Order, had directed the LDI Licensee to revert to its original rates (Interconnection Charges) for provision of Value-Added Telephony Call Routing Services (Interconnection Services) to the LL Licensee, which the LDI Licensee had increased in accordance with the law and its Reciprocal Carrier Service Agreement (Interconnection Agreement) with the LL Licensee. Azam & Rai argued before the High Court that the PTA's Enforcement Order was in blatant violation and contravention of the express provisions contained in the Pakistan Telecommunication (Re-organization) Act, 1996, the Pakistan Telecommunication Rules, 2000, the Interconnection Dispute Resolution Regulations, 2004 and the Interconnection Agreement. Furthermore, the Interconnection Agreement contains an arbitration clause, which provides that any dispute between the LDI Licensee and the LL Licensee arising from or in connection with the Interconnection Agreement would be resolved under the International Chamber of Commerce (ICC) Rules of Arbitration. Azam & Rai argued that the arbitration clause prevented the LL Licensee from lodging any Complaint with the PTA on the basis of the Interconnection Agreement and further prevented the PTA from adjudicating upon the dispute.
Azam & Rai's client is one of 14 LDI licensees in Pakistan and one of four LDI licensees, which Azam & Rai has represented, and continues to represent, before different High Courts in Pakistan in relation to various telecom-related disputes.

Azam, was invited to and participated in the Seminar/Workshop on "Trade Defence Laws” held under the auspices of the National Tariff Commission (NTC), Government of Pakistan, in collaboration with the United States Agency for International Development (USAID) Trade Project at the Lahore Chamber of Commerce & Industry (LCCI), Lahore on 8 October 2013.
The purpose of the seminar/workshop was to increase awareness about the legal and procedural aspects of trade remedy laws and how industries can avail remedies under these laws against unfair trade practices of dumping and subsidization. The seminar/workshop covered anti-dumping, countervailing and safeguarding measures.

In Writ Petition filed through Azam & Rai, the Lahore High Court restrains the PTA from taking action against Multinet Pakistan (Pvt.) Ltd.

In Writ Petition No. 2356/2010 filed by Azam & Rai before the Rawalpindi Bench of the Lahore High Court on behalf of Multinet Pakistan (Pvt.) Ltd. against the Pakistan Telecommunication Authority (PTA), the Lahore High Court has restrained the PTA from taking any action against Multinet Pakistan (Pvt.) Ltd. in relation to the payment of Access Promotion Contribution (APC) for the Universal Service Fund (USF) under the Access Promotion Regulation, 2005, pursuant to the Access Promotion Rules 2004 and the Pakistan Telecommunication (Re-Organization) Act, 1996.
Multinet Pakistan (Pvt.) Ltd., an Axiata (formerly TMI) Group Subsidiary, is one of 14 Long-Distance International (LDI) Licensees in Pakistan.
Multinet Pakistan (Pvt.) Ltd. is one of four LDI licensees, which Azam & Rai is representing before the High Court in the dispute, which all LDI licensees have with the PTA in relation to APC for USF payments. 5 out of 14 LDI licensees have consulted Azam & Rai in this regard.
